A divorce is “contested” when spouses cannot agree on one or more key issues, such as how to divide property, whether one spouse will pay maintenance, or where the children will live. These cases are decided in New York Supreme Court, and the outcome can shape your finances and family life for years. We represent spouses with the preparation and determination these cases require.
Issues we handle
- Equitable distribution. New York divides marital property fairly, which is not necessarily equally. We identify what is marital and what is separate property, such as assets owned before the marriage, gifts and inheritances, and trace funds that have been commingled.
- Family businesses and real estate. Valuing a business or professional practice, investment properties and the marital home, and protecting a business from disruption during the case.
- Hidden and overseas assets. Using financial discovery, subpoenas and forensic accountants to uncover income and assets, including those held abroad or in relatives’ names.
- Spousal maintenance and child support. Calculating support under New York’s statutory guidelines, and arguing for adjustments when the guidelines do not fit the family’s circumstances.

Our approach
We begin with a clear picture of the finances and your goals. Early in the case, we seek temporary orders for support, exclusive use of the home or protection of assets where needed. Throughout, we evaluate settlement offers against what a court is likely to do, so you can make informed decisions. When settlement is not possible, we are fully prepared for trial.
