When a loved one passes away, the family is often left with a stack of paperwork and little idea where to begin. In New York, most estates must go through the Surrogate’s Court before assets can be collected, debts paid and property distributed. We guide executors, administrators and families through each step so the estate is settled correctly and without unnecessary delay.

Proceedings we handle

  • Probate. When there is a will, we petition the Surrogate’s Court to admit it to probate and have the named executor appointed.
  • Administration. When there is no will, New York’s intestacy laws decide who inherits. We petition for the appointment of an administrator and identify the legal heirs.
  • Small estates. Estates with modest personal property may qualify for a simplified procedure, which we can use to save time and cost.
  • Ancillary proceedings. When someone who lived outside New York left property here, or a New Yorker left property in another state, we coordinate the additional filings required.

From appointment to final distribution

Once the court issues letters testamentary or letters of administration, the real work begins. We help the fiduciary to:

  • Locate and collect assets, including bank accounts, real estate and business interests
  • Notify creditors and pay valid debts and expenses
  • Sell or transfer real estate, working with buyers, brokers and title companies
  • Coordinate estate tax and final income tax filings with the accountant
  • Prepare accountings and obtain releases from beneficiaries before distributing the estate
