Trademark Litigation & Enforcement

Enforcing and defending trademark rights in federal court, before the Trademark Trial and Appeal Board, and on online marketplaces.

A trademark is only as strong as your willingness to protect it, and a trademark claim against your business can threaten your brand, your inventory and your online sales channels overnight. We represent brand owners enforcing their rights and businesses accused of infringement.

Enforcing your brand

  • Cease-and-desist letters. Often the fastest and most cost-effective way to stop an infringer.
  • Federal court litigation. Claims for trademark infringement, counterfeiting, false designation of origin and unfair competition, including requests for injunctions to stop ongoing harm.
  • Online marketplaces. Takedowns and brand protection on Amazon, eBay, Walmart, Shopify-based stores and social media.
  • Domain names. Recovering domain names registered in bad faith.

Defending your business

  • Infringement claims. Responding to demand letters and lawsuits alleging that your name, logo or products infringe another’s mark.
  • “Schedule A” cases. Brand owners increasingly file lawsuits against hundreds of online sellers at once and obtain orders freezing their marketplace accounts and funds, often in courts far from the seller. We help sellers respond quickly, contest the claims or the scope of the asset freeze, and negotiate the release of their accounts.
  • Marketplace complaints. Challenging improper takedown notices that remove your listings.

Before the Trademark Trial and Appeal Board

We represent clients in oppositions to stop a conflicting application from registering, in cancellation proceedings against existing registrations, including registrations that have been abandoned or were obtained improperly, and in appeals of USPTO refusals.

Our approach

Trademark disputes often move fast, especially when accounts are frozen or inventory is at stake. We assess the strength of the marks involved, the evidence of actual confusion and the commercial stakes, then pursue the path that protects your business most efficiently, whether that is a coexistence agreement, a negotiated settlement or litigation through trial.
